§ 1. General

 

Your personal data such as title, name, address, e-mail address, telephone number, bank details, credit card number will only be processed by us in accordance with the provisions of German data protection law and the data protection law of the European Union (EU). In addition to the processing purposes, recipients, legal bases and storage periods, the following provisions also inform you about your rights and the person responsible for your data processing. This data protection declaration only applies to our websites. If you are forwarded to other pages via links on our pages, please inform yourself there about the respective handling of your data.

 

§ 2 data processing to fulfill the contract

 

(1) Purpose of processing

Your personal data, which you provide to us during the ordering process, are required to conclude a contract with us. You are not obliged to provide your personal data. However, we cannot send you the goods without giving your address. For some payment methods, we need the necessary payment data in order to pass them on to a payment service provider commissioned by us. The processing of your data entered during the ordering process is therefore carried out for the purpose of processing the contract.

If you send us a request by e-mail, using a contact form or similar before concluding the contract, we will process the data received in order to carry out pre-contractual measures and, for example, to answer your questions about our products.

(2) Legal basis

The legal basis for this processing is Article 6 (1) b) GDPR.

(3) Categories of Recipients

Payment service providers, shipping service providers, hosting providers, if necessary merchandise management system, if necessary suppliers (dropshipping).

(4) Storage period

We store the data required for contract processing until the statutory and, if applicable, contractual warranty periods have expired.

We store the data required under commercial and tax law for the periods prescribed by law, usually ten years (cf. § 257 HGB, § 147 AO).

The data processed to carry out pre-contractual measures will be deleted as soon as the measures have been carried out and a contract obviously does not come about.

§ 3 Notes

 

(1) Purpose of processing

It is possible to write a comment. Your data such as name or pseudonym, email address, website will then only be processed for the purpose of publishing your comment.

(2) Legal basis

The legal basis for this processing is Article 6 (1) f) GDPR.

(3) Legitimate Interest

Our legitimate interest is the public exchange of user opinions on certain topics and products. The publication serves, among other things, for transparency and opinion-forming. Your interest in data protection is preserved because you can publish your comment under a pseudonym.

(4) Storage period

A specific storage period is not provided. You can request the deletion of your comment at any time.

(5) RIGHT TO OBJECT

You have the right to object at any time to data processing based on Art. 6 Paragraph 1 f) GDPR and not used for direct mail for reasons that arise from your particular situation.

In the case of direct mail, however, you can object to processing at any time without giving reasons.

§ 4 Further information

Google fonts

We use Google Fonts on our website to display external fonts. This is a service provided by Google LLC, 1600 Amphitheater Parkway, Mountain View, CA 94043 USA, hereinafter referred to as "Google".

When you click on an ad placed by Google, the conversion tracking we use saves a cookie on your device. These so-called conversion cookies lose their validity after 30 days and are not used to identify you personally.

If the cookie is still valid and you visit a certain page of our website, both we and Google can evaluate that you clicked on an ad placed by us on Google and were then redirected to our website.

With the information obtained in this way, Google creates statistics for us about visits to our website. This also gives us information about the number of users who clicked on our ad (s) and about the pages on our website that were subsequently accessed. However, neither we nor third parties who also use Google AdWords are able to identify you in this way.

§ 5 credit check

 

If we make advance payments, e.g. for payment on account, we can obtain credit information about you from the following companies: PayPal (Europe) S.à rl et Cie, SCA 22-24 Boulevard Royal L-2449 Luxembourg. For this purpose, we will forward your personal data (e.g. name and address) to this company. On the basis of mathematical-statistical procedures, it is checked how high the risk of payment default is. We make the conclusion of the purchase contract dependent on the result of the credit check.

(4) Storage period

The technically necessary cookies are usually deleted when the browser is closed. Permanently stored cookies have different lifespans from a few minutes to several years.

(5) RIGHT TO OBJECT

§ 7 social plugins

 

(1) We use social plugins from facebook.com, operated by Facebook Inc. 1601 S. California Ave, Palo Alto, CA 94304, USA. § 9 rights of the data subject

 

If your personal data is processed, you are a data subject within the meaning of the GDPR and have the following rights vis-à-vis the person responsible:

1. Right to information

 

You can request confirmation from the person responsible as to whether we are processing personal data relating to you.

If this is the case, you can request the following information from the person responsible

(1) the purposes for which the personal data are processed;

(2) the categories of personal data that are processed;

(3) the recipients or categories of recipients to whom the personal data relating to you have been disclosed or are still being disclosed;

(4) the planned duration of the storage of your personal data or, if no specific information is available, the criteria for determining the duration of the storage;

(5) the existence of a right to correction or deletion of your personal data, a right to restriction of processing by the person responsible or a right to object to this processing;

(6) the right to lodge a complaint with a supervisory authority;

(7) all available information on the origin of the data if the personal data was not collected from the data subject;

(8) The existence of automated decision-making including profiling in accordance with Art. 22 Para. 1 and 4 GDPR and - at least in these cases - meaningful information about the logic involved and the scope and intended effects of such processing for the data subject.

You have the right to request information about whether your personal data is being transferred to a third country or to an international organization. In this context, you can request that you have the appropriate guarantees in accordance with Art. 46 GDPR in connection with the transmission.

2. Right to rectification

 

You have a right to correction and / or completion vis-à-vis the person responsible if the processed personal data concerning you is incorrect or incomplete. The person responsible must make the correction immediately.

3. Right to restriction of processing

 

You can request that the processing of your personal data be restricted under the following conditions:

(1) if you dispute the correctness of the personal data concerning you for a period of time that enables the person responsible to check the correctness of the personal data;

(2) the processing is unlawful and you refuse to delete the personal data and instead request that the use of the personal data be restricted;

(3) the person responsible no longer needs the personal data for the purposes of processing, but you need them to assert, exercise or defend legal claims, or

(4) if you have objected to the processing in accordance with Art. 21 Paragraph 1 GDPR and it has not yet been determined whether the legitimate reasons of the person responsible outweigh your reasons.

If the processing of your personal data has been restricted, this data - apart from its storage - may only be allowed with your consent or for the establishment, exercise or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of an important public interest that tracked by the Union or a Member State.

If the processing restriction has been restricted in accordance with the above conditions, you will be informed by the person responsible before the restriction is lifted.

4. Right to cancellation

 

a) Obligation to delete

You can request the person responsible to delete the personal data relating to you immediately, and the person responsible is obliged to delete this data immediately if one of the following reasons applies:

(1) The personal data relating to you are no longer required for the purposes for which they were collected or otherwise processed.

(2) You revoke your consent on which the processing was based in accordance with Article 6 (1) (a) or Article 9 (2) (a) GDPR, and there is no other legal basis for the processing.

(3) You object to the processing in accordance with Art. 21 Paragraph 1 GDPR and there are no overriding legitimate reasons for the processing, or you object to the processing in accordance with Art. 21 Paragraph 2 GDPR.

(4) The personal data concerning you have been processed unlawfully.

(5) The deletion of your personal data is necessary to fulfill a legal obligation under Union law or the law of the member states to which the person responsible is subject.

(6) The personal data relating to you were COLLECTED in relation to the information society services offered in accordance with Art. 8 Para. 1 GDPR.

 

b) Information to third parties

If the person responsible has made the personal data concerning you public and is obliged to delete this data in accordance with Art. 17 Paragraph 1 GDPR, he shall take appropriate measures, including technical measures, taking into account the available technology and the implementation costs Way to process the data. c) Exceptions

The right to erasure does not exist if processing is necessary

5. Right to be informed

If you have asserted the right to correction, deletion or restriction of processing against the person responsible, the person responsible is obliged to notify all recipients to whom the personal data concerning you have been disclosed of this correction or deletion of the data or restriction of processing, unless , this proves to be impossible or involves a disproportionate effort.

You have the right vis-à-vis the person responsible to be informed about these recipients.

6. Right to data portability

 

You have the right to receive the personal data concerning you, which you have provided to the person responsible, in a structured, common and machine-readable format. The right to data portability does not apply to the processing of personal data that is necessary for the performance of a task that is in the public interest or is carried out in the exercise of official authority that has been transferred to the person responsible.

If the personal data relating to you are processed in order to operate direct mail, you have the right to object at any time to the processing of the personal data relating to you for the purpose of such advertising; this also applies to profiling insofar as it is associated with such direct advertising.

If you object to processing for direct marketing purposes, the personal data relating to you will no longer be processed for these purposes.

In connection with the use of information society services, you have the option - regardless of Directive 2002/58 / EC - to exercise your right of objection by means of automated procedures in which technical specifications are used.

8. Right to revoke the declaration of consent under data protection law

(2) is permissible on the basis of legal provisions of the Union or of the member states to which the person responsible is subject and these legal provisions contain appropriate measures to safeguard your rights and freedoms as well as your legitimate interests or

(3) takes place with your express consent.

However, these decisions may not be based on special categories of personal data in accordance with Article 9 Paragraph 1 GDPR, unless Article 9 Paragraph 2 Letter a) or g) applies and suitable measures have been taken to protect your rights and freedoms as well as your legitimate interests .

In the cases mentioned in paragraphs 1 and 3, the person responsible shall take appropriate measures to safeguard the rights and freedoms as well as your legitimate interests, including at least the right to obtain intervention by a person on the part of the person responsible, to express their own point of view and to be heard heard when contesting the decision.

10. Right to complain to a supervisory authority
